Evidence? You really need to educate yourself on the law. A lawsuit based on what? You do realize that lawsuits are only for CIVIL DAMAGES, right? What damages were there? Were his pants damaged? Was he limping? Did he suffer a broken tibia? Sorry, but a bruised ego doesn't count.
Furthermore, damages incurred in the commission of a crime are generally nullified. For example, if you slipped my wet floor and broke your neck while burglarizing me, no judge would recognize your damages. The fact is that he committed a crime -- trespassing, and that kick was a reaction to the trespass, and would not have occurred had he not committed that crime.
As for but the criminal charge of assault, nope. That's again is nullified by his crime of trespass. Her "assault" was a reaction to him breaking the law. If I whacked you with an umbrella while you were fleeing the scene of a crime, I won't be charged with a crime. He was leaving the scene of a crime, which again, is trespassing.
